These Terms of Service ("Terms") form a binding agreement between you and MQ City Builder ("we", "us", "our") and govern your use of the MQ City Builder game and website at mqcity.app (together, the "Service"). By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 13 years old (or 16 in jurisdictions that require a higher minimum age for data-processing consent) to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms in your jurisdiction. If you are using the Service on behalf of an entity, you represent that you are authorised to bind that entity.
The Service is a pre-release beta. It may contain bugs, missing features, and incomplete content. Game balance, mechanics, save formats, and pricing may change at any time without notice. We reserve the right to modify, suspend, or discontinue any part of the Service, with or without notice, and to wipe or migrate save data when necessary as part of the beta process. We will try to communicate breaking changes in advance where reasonable.
You can play without an account, but creating one lets you sync your cities across devices. You are responsible for:

We grant you a personal, non-exclusive, non-transferable, revocable licence to access and play the Service for your own non-commercial entertainment, subject to these Terms. This licence does not transfer ownership of anything to you.
While using the Service, you agree not to:
All code, art, music, branding, and design of the Service are the property of MQ City Builder or its licensors and are protected by copyright, trademark, and other intellectual-property laws. Except for the limited licence in section 5, no rights are transferred to you.
You retain ownership of any content you create within the Service such as your city layouts, district names, and configuration. By saving that content to the cloud you grant us a worldwide, royalty-free, sublicensable licence to host, store, and reproduce it for the purpose of providing the Service to you (e.g. so we can show it back to you on another device). This licence ends when the content is deleted from the Service.
You are responsible for ensuring that any text you enter (city names, district names, etc.) does not infringe anyone's rights or violate the conduct rules in section 6.
During the public beta, the Service is free to play. If we introduce paid options in the future (such as themed cosmetic packs or a paid version), prices, refund terms, and any platform-specific rules (e.g. App Store or Google Play refund policies, where applicable) will be disclosed at the point of purchase before you pay.
The Service relies on third-party providers including Supabase (authentication and database), GitHub Pages (hosting), and Cloudflare (DNS). Your use of those providers is also governed by their own terms and privacy policies. We are not responsible for outages or actions of third parties, but we will work with them to resolve issues that affect the Service.
You may stop using the Service at any time. You can delete your account via Settings → "Delete my account" inside the game or by emailing hello@mqcity.app.
We may suspend or terminate your access if you materially breach these Terms, abuse the Service, or use it in a way that could harm us or other players. Where reasonable, we will give notice and a chance to address the issue first. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, governing law) will continue to apply.
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the Service will be uninterrupted, error-free, secure, or free of harmful components. To the maximum extent permitted by law, we disclaim all such warranties.
To the fullest extent permitted by law, MQ City Builder and its developer will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, save games, goodwill, or other intangible losses, arising out of or related to your use of the Service. Our total cumulative liability for all claims related to the Service is limited to the greater of (a) the amount you paid us (if anything) for the Service in the twelve months before the claim, or (b) US$50.
Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions our liability is limited to the smallest extent permitted by law.
You agree to indemnify and hold MQ City Builder and its developer harmless from any claim, demand, loss, or damages arising out of (a) your breach of these Terms, (b) your misuse of the Service, or (c) your violation of any rights of a third party. We reserve the right to assume the defence of any matter for which you owe us indemnification, in which case you agree to cooperate with our defence.
We may update these Terms from time to time. When we make material changes we will update the "Last updated" date at the top and, where changes are significant, give notice in-game or by email to signed-in users. Continuing to use the Service after the changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it, without regard to its conflict-of-laws principles. Any dispute that cannot be resolved informally will be brought in the courts located in Ontario, Canada, and you consent to their personal jurisdiction. This section does not deprive you of any mandatory consumer-protection rights you have in your jurisdiction of residence.
If any provision of these Terms is held to be unenforceable, the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver of our right to do so later. You may not assign these Terms without our written consent; we may assign them to any successor or affiliate.
